LOCKER ASTORIA TERMS & CONDITIONS

  1. STORAGE
    1. The prices for usage are fixed at a price of  €10 / luggage / day. The storage time is valid within a calendar day. You are granted a free access during the storage day to your luggage through your own 8-digit code. Bognár Dorina sole proprietorship (address: [1143, Budapest, Zászlós street 26.]; hereinafter referred to as:” Locker Astoria”) offers a locker space hire service, it is not responsible for the custody of the luggage. The user is solely responsible for the goods included in the hired locker.
  1. PURPOSE AND LEGAL BASIS OF DATA PROCESSING
    1. Locker Astoria manages the names, email addresses and phone numbers of those who enter a contract with Locker Astoria. The purpose of the managing of the above data is to identify the persons who enter luggage storage contracts with our company to the extent necessary to fulfil the contract and to provide them with the information necessary to use the luggage storage service.
  1. The user guarantees that all data regarding their identity, as well as regarding the service are truthful, accurate and complete.
  1. Locker Astoria will keep the user’s personal details for as long as is necessary to provide the service as well as for as long as is necessary to comply with Locker Astoria’s legal obligations.
  1. The legal basis of the managing is based on Article 6 (1) (b) of Regulation (EU) 2016/679 of the European Parliament and of the Council, according to which the managing is necessary to fulfil the contract.
  1. Data will not be transferred to third parties. Data will not be transferred to a third country.
  1. Datas that are included in the emails are used and PII data is stored by Ketsh Kft. As a result, Ketsh Kft. (Headquarters: 7622 Pécs, Nagy Lajos király útja 14. fszt 3., Location: 1115 Budapest, Kelenföldi út 2., Tax number: 23686513-2-02, Company registration number: 02-09-078175) appears as a data processor in the booking processes.
  1. USAGE, OBLIGATIONS AND CONSEQUENCES
    1. Locker Astoria is – only in case of safety – justified to check the content of the items and justified refuse keeping items that are too valuable or have possible dangerous content. The customer acknowledges and agrees that Locker Astoria or any Governmental Authority have the right to open and investigate the luggage at any time for security reasons.
  1. The user undertakes to use the lockers for the sole purpose of depositing their property, which they temporarily need to keep in a safe place. Appropriately use the lockers and ensure that the locker has been properly closed when the user leaves the premises (after inserting or removing the luggage). Not use the lockers for illegal or unauthorized purposes. Not deposit any property whose possession requires a licence without licence or authorization. Locker Astoria does not accept storage of the following items: plants and animals, alive or dead; securities and negotiable certificates (bills of lading, currency, paper money, coins, credit cards and traveller’s checks); other non-tangible securities; material that can be considered as pornographic or indecent; weapons (firearms and bladed weapons); garbage; political material; hazardous materials; narcotic or psychotropic drugs; art objects; antiques; metals (gold, silver in any form and precious stones); bulky goods; documents (tender offers, both public and private, securities, food stamps and fuel coupons, etc..); architectural models; watches. It being the user’s exclusive responsibility to use the hired lockers to store any type of goods of special value. 
  1. The user must not provide their security code to any third party, being fully responsible for the breach of this obligation and its consequences.
  1. Not use the lockers to deposit goods to be collected by a third party. The lockers must not be used as a means of trafficking goods between parties. Locker Astoria does not authorize this use.
  2. The user is obligated to leave the lockers, at the end of the service, in the same condition in which they were found and, in particular, to notify Locker Astoria through [info@lockerastoria.hu] of any incident that the user may find in their use of the lockers or relating to their condition.
  1. Locker Astoria reserves the right to remove any object that does not comply with the rules of use of the lockers and that is a prohibited object. Under these circumstances, Locker Astoria will be authorized to call the police and report the behaviour, as well as withdrawing the prohibited objects. The user will be responsible for the objects placed in the lockers.
  1. In any case, the removal of prohibited items will entail a penalty of €50, this penalty will not exclude the non-compliant user from the obligation to indemnify Locker Astoria for the damages and losses caused.
  1. If the user uses the lockers without payment of a fee, Locker Astoria is entitled to access the lockers in order to remove the stored luggage, to free the lockers and make them available for use by Locker Astoria’s customers. In such circumstances, Locker Astoria will temporarily store the luggage and will attempt to contact the user who has missed the payment to return the luggage to the user (the cost of which will be borne 100% by the user). After fifteen days, without the user having been contacted, or without the user having contacted Locker Astoria and collected the luggage, the user shall be deemed to have abandoned the goods for all purposes. In such circumstances, Locker Astoria will cease to hold the goods and will dispose of them in such manner as it deems appropriate or suitable, depending on the type of abandoned item.
  1. Locker Astoria is doing its best to keep your belongings safe providing the following security offers: numeric lockers, the locker is monitored by 24/7 video surveillance with alarm; no damage risk due to the separated lockers; no card, no armband, no key to be lost only your personal 8-digit code. However, apart from our security system, we cannot be held responsible for other valuable items you wish to leave in our lockers. Camera recordings are kept for 1 month.
  1. Should a fault, obstruction or any other type of incident occur in the use of the luggage locker, the user will be able to consult the Locker Astoria assistance service by calling [+36 30 5969040/ + 36 30 4349034] or emailing: info@lockerastoria.hu.
  1. The user will be fully responsible for any damage or deterioration that may be caused to the lockers by their misuse or improper use. Under these circumstances, the user must compensate Locker Astoria for the physical damage caused to the locker(s) and for loss of earnings.
  2. And without limitation, the user causing the damage must pay Locker Astoria a daily hire penalty (€ 10/day) for each day the locker is unusable, as well as the cost of repair or replacement, which is quantified in the event of replacement at €500, regardless of the damages caused.
  1. The penalties detailed in this section will be paid by the user using the same means of payment used by the user when contracting the service or by bank transfer to the account indicated by Locker Astoria if required by the user. The user expressly accepts that Locker Astoria will charge the amounts established in this section using the user’s card or means of payment when contracting the service.
  1. SUBMIT COMPLAINT
    1. If you believe that your personal information has not been properly handled, please contact us in order to solve the matter peacefully and expeditiously.
  1. However, you also have the right to complain to a supervisory authority, in particular in the Member State of your habitual residence, place of work or alleged infringement, if you believe that our managing of personal data concerning you is unlawful.

By leaving your luggage on our premises and luggage storage, you accept our terms and conditions set in our storage contract and/or in the contract for the provision of different services, on your behalf and / or on behalf of any other interested person, regardless of whether you have signed our storage contract.

These Terms and Conditions and the legal relationship between the parties shall be governed by Hungarian law.

Locker Astoria and the user appoint the exclusive competence and jurisdiction of Budai Központi Kerületi Bíróság for the settlement of any dispute arising between them.
